Sanitary and Phytosanitary (SPS) Measures

BACKGROUND The Sanitary and Phytosanitary (SPS) Measures implemented aims to protect human, animal or plant life or health from pests and diseases that may be brought in by imported agricultural products. To achieve this goal, imposition of the SPS measures will be based on scientific justification to ensure that technical regulations, standards, and conformity assessment procedures are non-discriminatory and do not create unnecessary obstacles to trade. At the time this measure are necessary to protect human, animal or plant life or health.
SCOPE SPS applies to protect a Member's territory from other damage arising from the entry, establishment or spread of pests:
animal and plant life or health from the entry, establishment or spread of pests, disease-carrying or disease-causing organisms; human or animal life or health from food-borne risks (risks arising from additives, contaminants, toxins or disease-causing organisms in foods, beverages or feedstuffs); human life or health from diseases carried by animals, plants or products thereof.
These measures include sanitary and phytosanitary measures taken to protect the health of fish and wild fauna, as well as of forests and wild flora, from the risks stated above.
THE INSTITUTIONAL COVERAGE A wide range of authorities, includes:
central government bodies; local government bodies (which include provincial and state government bodies); and regional and non-governmental bodies.
Obligations may vary according to the type of authority.
STANDARDS SETTING BODIES
To ensure the measures applied are acceptable by importing countries, international standards, guidelines and recommendations from three standard-setting bodies will be used as a basis in developing SPS measures: The Codex Alimentarius Commission (Codex) for food safety. The International Office of Epizootics (OIE) for animal health and zoonoses. The International Plant Protection Convention Secretariat (IPPC) for plant health.
In developing SPS measures, under the WTO Agreement, Members are allowed to apply measures on a discriminatory basis, taking into account such factors as the difference in the level of prevalence of specific diseases or pests. In addition, Members are also allowed to restrict imports on a provisional basis, as a precautionary step, in cases where there is imminent risks of the spread of disease, and where the scientific evidence is in sufficient.
