The Technical Barriers to Trade (TBT) measures are implemented to ensure that regulations, standards, testing and certification procedures do not create unnecessary obstacles.
Under the WTO Agreement on Technical Barriers to Trade (TBT), states that "no country should be prevented from taking measures necessary to ensure the quality of its exports or for the protection of human, animal and plant life or health, of the environment, or for the prevention of deceptive practices, at the level it considers appropriate'. The agreement also provides that mandatory product standards should not be applied by countries to cause unnecessary obstacles to international trade. Product standards should be based on scientific information and evidence.
Technical Regulation is mandatory product standards which should be based on internationally agreed standards. They also are subjected to conditions which not constitute "unnecessary obstacles" to trade and do not discriminate. The agreement also sets out a code of good practice for both governments and non-governmental or industry bodies to prepare, adopt and apply voluntary standards. Over 200 standards-setting bodies apply the code. The TBT Agreement also includes other obligations, notably and transparency requirements.
TBT applies to all products, including industrial and agricultural products to ensure that technical regulations and standards, including packaging, marking and labelling requirements, and procedures for assessment of conformity with technical regulations and standards do not create unnecessary obstacles to international trade.
THE INSTITUTIONAL COVERAGE
The TBT Agreement applies to a wide range of bodies, both governmental and non-governmental. Members are responsible for the implementation of the TBT Agreement, but their obligation to ensure compliance varies according whether if it is a central, local or regional body, or a non-governmental entity.
STANDARDS SETTING BODIES
To ensure the measures applied are acceptable by importing countries, all measures will be based on best available relevant international standards, unless the relevant international standard is an inappropriate or ineffective to fulfil a legitimate objective.
