General Information

MITI has established the Strategic Trade Secretariat (STS) on 1 August 2010 to coordinate the implementation of the Strategic Trade Act (STA) 2010 [Act 708], in line with Malaysia's obligation under the United Nation Security Council Resolution (UNSCR) 1540.

The STA provides for control over the export, transshipment, transit and brokering of strategic items, including arms and related material, and other activities that will or may facilitate the design, development and production of WMD and their delivery systems.

Alongside the Malaysia Communication and Multimedia Commission (MCMC), the Atomic Energy Licensing Board (AELB) and the Pharmaceutical Services Division (PSD), Ministry of Health, STS controls and monitors the issuance of export/ transit / tranship permits and/or broker certificates and the use of strategic items and related matters.


As part of trade facilitation, Regulation 25 of STA provides the exemption of permit for transit and transshipmentsubject to fulfilling certain conditions.

Strategic Items are classified according to the Export Control Classification Number (ECCN), which is different from the standard Customs Harmonised System (HS) Code.

 

List of strategic items referred as the Strategic Trade (Strategic Items) Order (Amendments) 2014 can be accessed at

Items that are not listed above are categorized as unlisted if a person  is notified by the relevant Authority; or otherwise knows; or

has reasons to believe that any unlisted item will or may be used for a restricted activity.

 

Export/Transit/Transhipment/ brokering of Unlisted items requires an STA permit.
